1. Scope and seller identification
These Subscription and Pay-Per-View Terms apply to paid access purchased through OTT Platform. They are a development draft pending counsel approval.
The checkout page and receipt must identify the seller. Unless they expressly identify the platform operator or another party, the independent channel owner is the merchant and seller of record. Stripe processes payment information under its own terms. The seller absorbs Stripe's processing fees and other payment-provider charges. Bad Burrito Productions, INC may retain the channel owner's plan-based application fee—8% for Launch, 4% for Growth, and 2% for Network—from the gross amount collected for the viewer charge without increasing the total price presented to the purchaser. Platform support may assist with transactions without becoming the seller.
2. Required checkout disclosures
Before the purchaser confirms payment, checkout should clearly and conspicuously display the total price, currency, taxes or fee treatment, seller, content or channel included, billing frequency, trial or promotional period, renewal terms, minimum commitment if any, access window, cancellation method, refund policy, and material device or territory limits.
The purchaser must provide affirmative consent to recurring charges separately from unrelated terms where required. The seller and platform should retain the presented version, timestamp, transaction, and consent record for the legally required period.
3. Recurring subscriptions
A subscription continues for the disclosed billing period and automatically renews at the then-applicable disclosed price until canceled. By subscribing, the purchaser authorizes the seller and its payment provider to charge the selected payment method on each renewal date, including applicable taxes, until cancellation takes effect.
Access ordinarily continues through the paid period after cancellation, unless the offer says otherwise, a refund is issued, payment is reversed, fraud is suspected, or continued access would violate law or policy.
4. Trials and promotions
A trial or discounted period converts to a paid subscription at the price and frequency shown at enrollment unless canceled before the stated conversion deadline. Eligibility may be limited by person, household, payment method, channel, geography, or prior participation.
Promotional codes have no cash value, may not be resold, may be subject to expiration and usage limits, and may be revoked for fraud or error. Material trial and promotion conditions must be shown before acceptance.
5. Pay-per-view and event access
A pay-per-view purchase grants access only to the identified content, event, replay, territory, devices, and viewing window. It does not grant permanent ownership or a downloadable copy unless the offer expressly says so.
Event times, replay availability, and included programming must be stated in the offer. Minor schedule or production changes do not automatically create a refund right, but material cancellation, failure to provide purchased access, or mandatory law may require a refund or comparable remedy.
6. Gifts
Gift access is subject to the offer's eligibility, expiration, territory, redemption, and account requirements. Gifts are not cash, stored value, or freely transferable unless expressly stated. A gift does not renew automatically unless the recipient separately accepts recurring terms and supplies a payment method.
The purchaser is responsible for an accurate recipient address. We may block or revoke gifts obtained through fraud, resale, payment reversal, or policy evasion.
7. Cancellation
A subscriber may cancel through the account subscription control or the same medium used to subscribe, as required by applicable law. Online subscribers must have an online cancellation path that does not require an avoidable telephone call, in-person visit, or retention interaction.
Cancellation stops future renewals after it is processed; it does not automatically refund prior charges. The subscriber should retain confirmation. Deleting an app, ceasing to watch, removing a payment method, or closing an unrelated account does not by itself cancel a subscription.
8. Refunds
Except where the offer states otherwise or law requires, completed subscription-period, pay-per-view, and gift purchases are final. A seller may approve a full or partial refund for duplicate charges, material service failure, event cancellation, unauthorized payment, or another documented exception.
Refunds return to the original payment method when practicable and may revoke corresponding access. Processing time depends on Stripe and the financial institution. Nothing in this policy limits mandatory refund, cooling-off, chargeback, or consumer remedies.
9. Price and term changes
The seller may change a recurring price or material subscription term prospectively. It must provide the notice, timing, and renewed consent required by applicable law before the change takes effect. Continued use alone will not substitute for affirmative consent where the law requires it.
If a purchaser does not accept a change, the available remedy is to cancel before the change becomes effective, without limiting mandatory rights.
10. Failed payments, disputes, and chargebacks
If a charge fails, the seller or payment provider may retry it, request an updated method, pause benefits, or end access. Entitlements may be revoked after a refund, dispute, chargeback, fraud finding, or cancellation where the paid right no longer exists.
Contact the seller or platform before initiating a chargeback so a suspected billing error can be investigated. This request does not waive the right to dispute a charge with a financial institution. Knowingly submitting a false dispute may lead to account restriction and lawful recovery efforts.
11. Taxes, currency, and payment methods
Prices are charged in the currency shown. The purchaser is responsible for bank conversion, international, or payment-method fees. Taxes will be collected when configured or legally required. The seller remains responsible for its tax obligations even when the platform displays estimates or facilitates collection.
The payment provider may decline or delay transactions under its fraud, sanctions, identity, network, or regulatory controls.
12. App stores and web purchases
The current OTT Services and Stream TV mobile and television releases are consumption-only reader apps. They do not offer app-store purchases, process card details, or grant access from client purchase state. Subscriptions and paid access originate on the OTT Video web platform, and the viewer signs in to restore server-verified access. Downloading an app, creating a free account, or signing in does not itself create a paid subscription.
If a future release offers a purchase through Apple, Google, Roku, Amazon, or another app store, it will do so only after the applicable store rules, approvals, billing, cancellation, refund, commission, disclosure, and family-sharing requirements have been implemented. No such app-store purchase is offered in the current releases.
An app may provide account information or an external account link only where the applicable store rules and approvals permit it. The app and checkout must identify material differences before purchase. Store commissions or rules may result in different prices or features across platforms where permitted by law.
13. Receipts, support, and disputes
A receipt or durable confirmation should identify the seller, purchase, amount, date, renewal terms when applicable, and cancellation or support method. Keep it for your records.
Billing questions should first be sent to the seller identified on the receipt. Platform assistance is available at dave@badburrito.com. The Platform Terms and Viewer Terms govern disputes and limitations, subject to non-waivable law.
