1. Intended launch posture
This Children and Age Policy is a development draft for OTT Platform. The intended initial posture is a general-audience service not directed to children under 13. Counsel must approve age design, content scope, and jurisdictional rules before production.
A person must be at least 13 to create a viewer account and at least 18, or the age of legal majority, to open a channel, administer an organization, enter contracts, accept payouts, or purchase without required adult authorization.
2. Children under 13
Children under 13 may not create accounts or submit personal information through the general-audience Service. We do not knowingly collect their personal information without a legally sufficient verifiable-parental-consent program.
If we learn that an under-13 child supplied personal information, we will investigate, restrict the account or feature, delete information where required, preserve only what law or safety requires, and document the response. A neutral age screen must not encourage a child to falsify age.
3. Child-directed channels and programming
Channel owners must accurately identify programming or experiences directed to children. Factors may include subject matter, visual and audio style, child performers, language, activities, advertising, intended audience, and competent audience evidence.
A channel owner may not treat child-directed content as general audience merely by adding a disclaimer. Child-directed accounts, personalized recommendations, comments, chat, targeted advertising, push, email, profiling, precise location, and third-party SDKs require a separate approved COPPA and child-safety design before activation.
4. Requirements before serving children
- Counsel-approved child-specific and parent notices describing collection, use, disclosure, retention, and rights.
- Direct notice to parents and verifiable parental consent before collection where required.
- Data minimization, purpose limits, security, provider restrictions, parental access and deletion, and deletion when information is no longer necessary.
- Separate review of advertising, analytics, push, email, contests, community, education, and app-store requirements.
- Age-assurance methods proportionate to risk and designed to avoid unnecessary collection.
- A trained response process for safety reports, grooming, exploitation, and mandatory reports.
5. Minors appearing in content
A creator featuring a minor must obtain legally sufficient parent or guardian authorization and comply with child labor, education, trust-account, working-condition, safety, privacy, publicity, union, and compensation rules that apply to the production and territory.
Do not publish a minor's private contact, school, routine, precise location, medical information, credentials, or other information that creates avoidable risk. Titles, thumbnails, metadata, comments, sponsors, and clips must not sexualize, exploit, shame, or invite inappropriate contact with a minor.
6. Teen users
Users aged 13 through 17 may use age-appropriate viewer features with parent or guardian involvement where required. They may not administer channels, enter seller or sponsor agreements, accept payouts, or make purchases they are not legally authorized to make.
Teen defaults should favor privacy and safety. Direct messages, public profiles, targeted promotions, location, adult content, and contact from unknown adults require specific product and safety review before launch.
7. Schools and organizations
A school, club, association, or other organization must have authority to provide member data and grant access. It may not rely on the platform as its agent for parental consent unless a written agreement expressly defines that role and applicable law permits it.
Education deployments may implicate FERPA, state student-privacy laws, school-contract rules, and additional security and deletion duties. They require a separate written review before student data is imported.
8. Advertising and communications involving minors
Behavioral advertising to children is outside the intended launch scope. Creators and sponsors must not exploit inexperience, pressure children to purchase, encourage disclosure of personal information, or advertise prohibited or age-restricted products to minors.
Marketing email, push, contests, and promotions involving minors require age-appropriate notice, any necessary parental permission, and easy preference controls.
9. Parent and guardian requests
A parent or guardian who believes a child supplied information or appears in content without appropriate authority may contact dave@badburrito.com with the relevant account, channel, URL, relationship, and request. We may verify identity and guardianship before disclosing or deleting information.
For an immediate threat or exploitation concern, contact emergency services or the appropriate child-safety authority. Platform reporting is not an emergency channel.
10. International age rules
Some jurisdictions set a higher digital-consent age or impose additional age-assurance, platform-design, advertising, and child-safety duties. The responsible channel owner and platform must complete jurisdiction-specific review before intentionally offering child or teen services there.
