1. Development and activation status

This is a development draft pending counsel approval. The platform must register a designated agent with the U.S. Copyright Office, publish matching contact information, adopt and reasonably implement the repeat-infringer policy, train operators, and maintain an auditable notice workflow before relying on DMCA safe-harbor protections.

Designated agent: [Register and insert the designated DMCA agent before production]. Mailing address: [Counsel to insert the legal mailing address before production]. Development email: dave@badburrito.com.

2. Copyright commitment

Channel owners must upload and distribute only content they are authorized to use. We respond to complete, good-faith copyright notices and counter-notices under 17 U.S.C. § 512 and may remove or disable content, live streams, downloads, or accounts while a claim is evaluated.

The DMCA process addresses copyright. Trademark, privacy, publicity, defamation, impersonation, accessibility, safety, contract, and other complaints should use the general reporting method and clearly identify the legal basis.

3. Copyright-infringement notice

A copyright owner or authorized agent should send a written notice to the registered agent containing all of the following:

  • A physical or electronic signature of the owner or authorized agent.
  • Identification of the copyrighted work claimed to be infringed, or a representative list if one notice covers multiple works at one online location.
  • Identification of the material claimed to infringe, with URLs or information reasonably sufficient for us to locate it. Channel names alone may be insufficient.
  • The claimant's name, mailing address, telephone number, and email address.
  • A statement of good-faith belief that the complained-of use is not authorized by the copyright owner, its agent, or law.
  • A statement that the notice is accurate and, under penalty of perjury, that the claimant is authorized to act for the owner of an exclusive right allegedly infringed.

4. How we process a notice

We may request missing information, assess whether the notice substantially complies, preserve relevant records, disable access, and send the notice and claimant contact information to the affected channel owner or uploader. We do not decide ownership disputes as a court and may decline abusive, fraudulent, facially invalid, or non-copyright notices.

If content presents an urgent safety or legal issue, separate policy or legal action may occur regardless of DMCA status. Removal from the platform does not necessarily remove copies from third-party sites, search caches, or devices.

5. Counter-notification

An affected uploader who believes material was removed because of mistake or misidentification may send the registered agent a written counter-notification containing:

  • The uploader's physical or electronic signature.
  • Identification of the removed material and where it appeared before removal.
  • A statement under penalty of perjury of good-faith belief that removal or disablement resulted from mistake or misidentification.
  • The uploader's name, mailing address, and telephone number.
  • Consent to the jurisdiction of the federal district court for the uploader's address, or if outside the United States, an appropriate federal district where the platform may be found, and acceptance of service from the original claimant or its agent.

6. Restoration after a counter-notice

We may send a valid counter-notice to the claimant. Unless the claimant notifies us that it has filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the material no sooner than 10 and no later than 14 business days after forwarding the counter-notice, subject to other rights, policies, contracts, and legal obligations.

Restoration is discretionary where a separate policy violation, rights expiration, court order, safety issue, or technical limitation independently supports continued restriction.

7. Repeat-infringer policy

In appropriate circumstances, we terminate users who repeatedly infringe copyright. We may consider the number, recency, reliability, severity, and outcome of notices; counter-notices; retractions; court decisions; account relationships; and evidence of deliberate evasion. We do not use a fixed count where doing so would ignore clear abuse or valid correction.

We may link related accounts, prevent re-registration, disable monetization, withhold disputed funds as allowed, and preserve records. We accommodate standard technical measures as required by law and do not interfere with them without lawful justification.

8. Misrepresentation and abuse

Knowingly and materially misrepresenting that material infringes or was removed by mistake may create liability under 17 U.S.C. § 512(f). Notices and counter-notices are legal communications and may be disclosed to the parties, advisers, service providers, transparency databases, or authorities as permitted by law.

Do not submit notices to suppress criticism, competition, fair use, licensed uses, public-domain material, or lawful speech. We may restrict accounts that abuse reporting tools.

9. Other rights and own content

If content violates a trademark, publicity, privacy, contract, or other right, identify the right, material, exact URL, ownership or authority, factual basis, requested action, and reliable contact information. We may request a court order or additional evidence for contested claims.

If you are a channel owner reporting unauthorized copies of your own content, include ownership records and identify both the authorized original and complained-of location. The platform does not provide legal representation or guarantee recovery from infringers.

10. Contact and records

Until the registered agent is confirmed, development inquiries may be sent to dave@badburrito.com; this placeholder does not represent completed Copyright Office registration. We will retain notices, counter-notices, forwarding records, actions, appeals, and repeat-infringer decisions according to the approved legal-retention schedule.
